Tim always carries it, and Tim is a rare underground caster who is easy to miss entirely. He turns up in the Cavern layer, more readily at night, and he is one of the few early enemies who will simply kill an unprepared player. Beating him is the only way to get the hat, so plenty of magic players go without one for a long stretch.
using it
This is the early magic helmet slot, and it works with any gem robe or with the Mystic Robe rather than demanding one matched piece. That flexibility is the point, since the robes are common shop and chest finds, so one hat completes a set you likely already own half of. Most of the value sits in the set's critical strike bonus rather than in the hat on its own.
It lost a lot of its original damage bonus and picked up defense in exchange, so it is a steady piece now rather than an early power spike. The Magic Hat fills the same slot if Tim never shows.
In Celebration Mk 10 and Zenith worlds it quietly hands out a minion slot as well, which makes it worth a second look for hybrid builds on those seeds.
